Terms of service
**MysteryBites Terms of Service**
**Effective Date: [April 8, 2026]**
These Terms of Service (“Terms”) govern your use of the MysteryBites website, mobile application, and subscription service (collectively, the “Service”) operated by 1001562149 ONTARIO INC. (“we,” “us,” or “our”). By creating an account or subscribing to our service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
### 1. Subscription and Billing
- **Subscription Plans**: MysteryBites offers monthly subscription boxes in Solo, and Office/Family tiers. Pricing is clearly displayed on the website at the time of purchase and may be updated without notice.
- **Billing Cycle**: You will be charged the full subscription amount **at the time of sign-up**. Subsequent charges will occur automatically on the **25th of each month** (or the next business day if the 25th falls on a weekend or holiday).
- **Taxes and Fees**: All prices are in CAD and exclude applicable taxes (GST/HST), shipping, and handling, which will be added at checkout where required.
### 2. Shipping and Delivery
- Boxes are shipped within the **first 5 business days of each month**.
- Delivery times vary by location and carrier (Canada Post or selected courier).
- We are not responsible for delays caused by carriers, customs (for international orders), or incorrect shipping addresses provided by you.
- Risk of loss or damage passes to you upon shipment.
### 3. Theme Selection and Random Assignment
- Each month we offer four themed boxes. You will receive an email and in-app notification with theme options and flavor previews early in the month.
- The **theme selection cutoff is the 20th of the month** (11:59 PM ET).
- If you make a selection by the cutoff, your chosen theme will be shipped.
- If you do **not** select a theme by the 20th, or if you sign up **after the 20th**, you will be automatically assigned a **random box** from available inventory. We aim to maintain balanced stock, but the exact theme cannot be guaranteed.
- Once the cutoff passes, theme selections are final and cannot be changed.
### 4. Cancellation and Pauses
- You may cancel your subscription **at any time** through your account dashboard.
- Cancellation takes effect at the end of the current billing period. You will receive the box for the month in which you cancel (if it has not yet shipped).
- No refunds are issued for partial months or already-shipped boxes.
### 5. Allergen Warning and Product Safety
- Our boxes contain snacks that **may include common allergens** such as peanuts, tree nuts, milk, soy, wheat, eggs, sesame, and sulphites.
- **You are responsible** for reviewing all ingredient labels and allergen information included with each box before consumption.
- We are not liable for any allergic reactions, adverse effects, or health issues resulting from consumption of our products.
- We make reasonable efforts to provide accurate ingredient lists via the QR code and printed materials, but formulations can change and cross-contamination is possible in manufacturing facilities.
### 6. Changes to Service and Pricing
- We may modify subscription prices, themes, or features with at least 30 days’ notice via email or website announcement.
- Continued use of the Service after changes constitutes acceptance of the new terms.
- We reserve the right to modify or discontinue any theme or the Service itself with notice where required by law.
### 7. Intellectual Property
- All content on the MysteryBites website and app (text, images, logos, theme descriptions, mood boards) is owned by us or our licensors and protected by copyright and trademark law.
- You may not reproduce, distribute, or create derivative works from our content without prior written permission.
### 8. Limitation of Liability
- To the maximum extent permitted by law, MysteryBites shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or consumption of our products.
- Our total liability to you for any claim shall not exceed the total amount you paid to us in the 12 months preceding the claim.
- We do not guarantee that every snack in every box will be available or that the mystery element will meet your expectations.
### 9. Disclaimers
- The Service and products are provided “as is” without warranties of any kind, express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.
- Snack availability and exact contents are subject to change based on supplier stock and seasonality.
### 10. Governing Law
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
- Any disputes shall be resolved exclusively in the courts located in Toronto, Ontario.
### 11. Miscellaneous
- **Entire Agreement**: These Terms constitute the entire agreement between you and MysteryBites.
- **Severability**: If any provision is found invalid, the remaining provisions remain in full force.
- **No Waiver**: Our failure to enforce any right does not constitute a waiver.

By subscribing, you acknowledge that you have read, understood, and agree to these Terms of Service, including the allergen warning and random box assignment policy.
